DISTANCE SALES CONTRACT

 

1. PARTIES

 

This Distance Selling Agreement; It was concluded electronically between the Client and the Therapist.

 

Talkids is only an intermediary service provider and is not a party to this agreement.

 

2. SUBJECT OF THE CONTRACT

 

This contract includes the online language and speech therapy service to be provided by the Therapist via remote communication tools;

     •           Law No. 6502 on Consumer Protection

     •           Distance Contracts Regulation

 

Regards its regulation within the scope.

 

3. DEFINITION AND SCOPE OF THE SERVICE

 

3.1. The service is an individual therapy service offered by the Therapist online.

 

3.2. The service does not constitute a medical emergency.

 

3.3. It does not include a physical examination.

 

3.4. Session content, method and professional evaluation authority belongs entirely to the Therapist.

 

3.5. Talkids only provides the technical infrastructure and payment system.

 

4. SESSION DURATION

 

Each therapy session is planned for 40 (forty) minutes.

 

Delays caused by the client do not extend the duration of the session.

 

If technical problems are caused by the Client, they do not result in the right to a refund.

 

5. FEES AND PAYMENT

 

5.1. The service fee is the amount specified on the payment page.

 

5.2. Payment is collected through Talkids payment infrastructure.

 

5.3. The therapist is obliged to issue invoices in accordance with the legislation.

 

5.4. Talkids is an intermediary platform, not a service provider.

 

6. PACKAGES AND DURATION OF USE

 

6.1. Sessions purchased within the scope of the package are valid for 1 (one) year from the date of purchase.

 

6.2. At the end of the period, unused session rights automatically expire.

 

6.3. No refunds will be made for expired rights.

 

7. RIGHT OF WITHDRAWAL

 

The client has the right to withdraw within 14 (fourteen) days from the establishment of the contract.

 

Request for withdrawal must be submitted in writing.

 

7.1. RIGHT OF WITHDRAWAL EXCEPTIONS

 

The right of withdrawal cannot be exercised in the following cases:

 

a) If the performance of the service has started with the express approval of the Client

b) If an instant appointment was purchased and the service was performed immediately

c) In terms of used sessions

 

Instant appointment is within the scope of the right of withdrawal exception in accordance with Article 15 of the Distance Contracts Regulation.

 

8. USED SESSIONS AND DISCOUNT CREDITS

 

8.1. In case of withdrawal, used sessions will not be refunded.

 

8.2. If a package discount is applied:

     •           Used sessions are calculated on the unit price without discount.

     •           Discount difference is offset.

     •           The remaining amount will be refunded.

 

9. APPOINTMENT CANCELLATION AND POSTPONEMENT CONDITIONS

 

9.1. The client can cancel or change the scheduled session at least 24 hours in advance.

 

9.2. If cancellations are made less than 24 hours in advance, the session will be deemed used.

 

9.3. Talkids may impose cancellation limits to prevent system abuse.

 

9.4. In case of exceeding the limit, temporary appointment restrictions may be applied.

 

10. INSTANT APPOINTMENT

 

Instant appointment is the type of appointment where the service starts immediately after the purchase.

 

The right of withdrawal does not apply to these services.

 

11. INFORMATION ON DISTANCE HEALTH SERVICE

 

The client accepts the following:

     •           The service is offered via remote communication.

     •           There is no physical examination.

     •           In case of emergency, 112 and relevant health institutions should be contacted.

     •           The platform does not provide emergency response services.

 

12. PRIVACY AND RECORDING PROHIBITION

 

12.1. Sessions are confidential.

 

12.2. The Client cannot make audio or video recordings without the written permission of the Therapist.

 

12.3. Unauthorized recording results in legal and criminal liability.

 

13. TECHNICAL RESPONSIBILITY

 

The client is responsible for providing the internet connection and device infrastructure.

 

Technical problems caused by the client are not a reason for refund.

 

14. LIMIT OF LIABILITY

 

Professional responsibility arising from therapeutic service belongs to the Therapist.

 

Talkids is only an intermediary platform.

 

15. DISPUTE RESOLUTION

 

In Disputes:

     •           Consumer Arbitration Committees within monetary limits

     •           Consumer Courts in cases exceeding the limit

 

is authorized.

 

16. ENFORCEMENT

 

The client is deemed to have accepted this agreement electronically by completing the payment process.

 

The contract enters into force at the time of electronic confirmation.
